What Is Civil Litigation?

Civil cases deal with non-criminal circumstances. In other words, they do not involve a criminal offense. In a civil trial, the person, or party, who suffers the loss is called the “plaintiff.” The person, or party, who caused the loss is called the “defendant.” In a trial, the plaintiff is trying to gain financial compensation for their losses.

Damages in Civil Litigation Cases

Unlike a criminal case where prosecutors may pursue incarceration or other punishments, the outcome of a civil case is financial compensation for alleged losses. Non-financial compensation may also be recuperated depending on the case. These “compensatory” and “general damages” can come in the form of a defendant paying the plaintiffs medical expenses, compensating them for lost revenue or giving them a sum of money the court has found equal to the plaintiff’s pain and suffering.

Although rare, a civil court can also allow for punitive damages, or damages that go beyond general and compensatory and are intended to punish the defendant. These may be awarded when the court finds egregious negligence, willful or wanton misconduct or intentional injury in the case.
