- You are found to have a Blood Alcohol Content (BAC) of 0.08% or higher while operating, or in control of, a private vehicle on a public road, or a road accessible to the public
- You are found to have a BAC of 0.04% or higher while operating a commercial vehicle
- You are a minor who was found to have a BAC of 0.02% or higher while operating any motor vehicle
Often, how you are charged will depend on the circumstances and be at the discretion of the issuing or arresting officer, and your final charge may be at the discretion of the presiding judge.
Potential Penalties for a DUI in Nebraska
A DUI conviction can result in penalties from both the court and the DMV.
On the DMV side, you’ll automatically add six points on your driver’s license. In Nebraska, every violation earns you points. You can earn up to twelve (12) points in a two year time period before you will have an automatic license revocation. In addition to being assessed 6 points on your record, you license will be automatically revoked fourteen days after you were cited for DUI. The length of this suspension depends on factors like your driving history, whether you took a breathalyzer test, and your criminal record.
For a first offense, the penalties can include:
- A $500 fine
- Up to 60 days in jail
- Up to a 1 year suspension of your driver’s license
For a second offense, the penalties can include:
- Fines up to $1,000
- Up to six months in jail, with a mandatory minimum of 10 days jail even if you are given probation
- A license revocation of up to 15 years if your blood alcohol level was over .15 (18 months if it was under .15)
A third offense can be a felony if your blood alcohol level was over .15 and can lead to:
- A $1,000 fine if your blood alcohol level was under .15 and up to $10,000 if your blood alcohol level was over .15
- Up to one (1) year in jail if your blood alcohol level was under .15 and up to three (3) years in prison if your blood alcohol level was over .15
- An 18 month to 15-year revocation of your driver’s license
